Neighbor Dispute

Description: Neighbor dispute: property damage.

HOH client: Respondent Property Owner

Key issues: Demonstrate that claim was untimely, poorly documented, negotiate dropping of claim.

During a severe storm, a tree allegedly fell from one property to an adjoining property, supposedly causing damage. No legal action was filed at the time, but many months later, the second neighbor sought damages from the first. Holm & O’Hara LLP was retained to represent the first neighbor. When our preliminary investigation revealed that the period within which the claim should have been filed had expired, we were able to persuade the second neighbor to drop the claim, saving both sides from the time and money involved in a protracted court battle.
